The PSD-ALDE Government has just announced, through thevoice of the Minister of Justice, Tudorel Toader, their intention to modify the justice laws package (The laws no.303, 304 and 317 / 2004).

The Platform Romania 100 draws attention to the negative effects which some of the proposed changes will have on the independence of justice and the checks and balances between the state powers.

The independence of justice will be seriously affected by moving the Judicial Inspection from the Superior Council of Magistracy (SCM) under the Ministry of Justice. This is opening the way towards the interference of the political factor into the magistrates’ careers, through taking disciplinary investigations of magistrates from SCM competence, as the guarantor of judicial independence.

At the same time, the proposed amendments of material liability of magistrates may introduce an additional pressure on judges and prosecutors, considering that, at present, the magistrates’ liability is regulated in clear and unequivocal terms.

Removing the President of Romania from the procedure of appointing the senior management of the main prosecution offices will affect the checks and balances between the state powers and creates a model which has no equivalent in other Member States.

Through the adoption of the amendments announced today by Minister Tudorel Toader, the magistrates’ professional career will be more vulnerable at political pressures, dropping down to the level of the year 2004, before the adoption of the legislative package for the reform of the judicial system.

The Platform Romania 100 considers that the deterioration of magistrates’ career, of which it has warned 3 months ago, is quickly consolidated through the actions taken by the PSD-ALDE coalition.
